General Terms and Conditions of Sale
Applicable from April 04, 2025.

The Client:
Any natural or legal person ordering a service via the website www.sophiemann.net, by email, or any other means.
Article 1: Purpose
These General Terms and Conditions of Sale (GTCS) govern the graphic design and communication services provided by Sophie MANN (hereinafter "the Service Provider") to the Client. They apply to any order placed via the website www.sophiemann.net, by email, or any other channel. Any order implies unconditional acceptance of these GTCS.
Article 2: Services Offered
The Service Provider offers graphic design and communication services, including but not limited to:
* Graphic design (logos, posters, flyers, visual identities).
* Web design.
* Photography.
* Video.
* Copywriting.
* Art direction.
* Communication services.
The details of each service (content, deadlines, revisions) are specified in a quote or specific contract.
Article 3: Quote and Order
Any quote is valid for 30 days.
Any order is validated by the Client's signature on the quote and payment of a 50% deposit.
Article 4: Payment Terms
* Payment methods:
* 50% upon order, payable by bank transfer, Orange Money, RIA, Wave, or cash against receipt.
* Balance upon delivery, transmission of final files, or launch of a website.
* Late payment: any delay in payment incurs a 2% penalty on the remaining amount for each 7-day period.
Article 5: Execution Deadlines
Deadlines are specified in the quote. They begin upon receipt of the deposit and the necessary elements provided by the Client (brief, images, texts). Any delay by the Client may postpone delivery without engaging the Service Provider's liability.
Article 6: Obligations of the Service Provider
The Service Provider undertakes to:
* Perform the services with care and professionalism.
* Provide a defined number of proposals and revisions (as indicated in the quote). Additional revisions will be quoted and billed by the hour.
Article 7: Obligations of the Client
The Client undertakes to:
* Provide the necessary elements within the agreed deadlines.
* Validate stages within a reasonable timeframe of Exemplary 48 hours maximum (unless otherwise agreed) or provide clear and precise correction instructions by email.
* Make payments according to the specified terms.
Article 8: Delivery
Files are delivered digitally (email, download link) after full payment.
In the case of website design, the site will be connected to its official domain name after payment of the balance. In case of non-payment, the site will no longer be accessible. It will be archived for 30 days. After this period, the site will be deleted.
Article 9: Copyright and Ownership
* Usage rights for the creations are transferred to the Client after full payment.
* The Service Provider retains the right to showcase their work in their portfolio or for promotional purposes, unless the Client provides written opposition.
Article 10: Withdrawal and Cancellation
* After start: The Client may withdraw, but the deposit remains with the Service Provider.
* During performance: In case of cancellation by the Client, amounts already paid are non-refundable. If cancellation comes from the Service Provider, the deposit is refunded, except in cases of Client default, such as failure to provide a brief or required elements.
Article 11: Liability
The Client is responsible for the accuracy of the data transmitted to the Service Provider.
Under no circumstances can the Service Provider be held liable for the dissemination of false or incomplete information provided by the Client.
The Service Provider reserves the right to refuse to disseminate certain information if they deem it harmful to third parties.
They (the Service Provider) also reserve the right to refuse any service involving communication in areas such as harm to nature or the environment, violations of human rights, violence in any form, promotion of bad morals, moral decadence, human or animal exploitation, polluting industries and/or those supporting wars or terrorism, or, more generally, any activity harmful to humans or the planet.
Article 12: Disputes
In the event of a dispute, the Parties will prioritize amicable resolution. Failing that, the dispute will be submitted to the competent court in Dakar, in accordance with the Senegalese Code of Civil and Commercial Obligations.
Article 13: Modification of GTCS
The Service Provider reserves the right to modify these GTCS. The applicable conditions are those in force on the date of the order.
